Court strikes out theft case against mason

 

An Upper Area Court in Gwagwalada, FCT, on Thursday struck out a case of theft filed against a 25-year-old mason, Lawal Mohammodu for lack of diligent Prosecution.

The police charged Mohammodu, who resides in Kutunku, Gwagwalada , on Nov. 9, 2021, with  criminal trespass and theft.

The defendant had pleaded not guilty to the charge.

The Judge, Malam Sani Umar, struck out the matter, discharged and acquitted Mohammodu, following the absence of the nominal complainant.

”I am striking out this matter. Since it was mentioned in November 2021, the prosecutor has failed to bring in any witness.

“The nominal complainant has been absent from court and this case has lingered for sometimes now”, he said.

Earlier, the Prosecution Counsel, Malam Abdullahi Tanko alleged that Mohammodu criminally trespassed into the complainant, Venchang Tangtur’s house in Kutunku, Gwagwalada on Nov. 3, 2021.

Tanko said that the defendant also the complainatts wife’s Nokia phone worth N21,000,  Guaranty Trust Bank ATM card, Zenith bank ATM card, Unity bank ATM card and N20,000 cash.

He said that during police investigation the defendant confessed that he removed the aluminium frames and glasses from an uncompleted building in Kutunku.

The prosecutor said that the offence contravened the provisions of sections 348 and 287 of the Penal Code.
